General Terms and Conditions of Burgtheater GmbH, Wiener Staatsoper GmbH and Volksoper Wien GmbH

1.  Scope of application

1.1 These General Terms and Conditions (“GTC”) apply to ticket sales for events, sales of goods (e.g. theater programs, CDs, DVDs, merchandise items) and other services (e.g. entitlement to receive live broadcasts or video-on-demand) of Burgtheater GmbH, Wiener Staatsoper GmbH and Volksoper Wien GmbH (together “Stage Companies”, individually “Stage Company”), whereby the Stage Company from which tickets, goods or services are purchased is the contractual partner in each case. Sales are carried out on the one hand by the Stage Companies themselves and on the other hand by ART for ART Theaterservice GmbH (“ART for ART”) in the name and for the account of the respective Stage Company, in each case on the basis of these GTC.

1.2 In addition to these GTC, separate conditions (e.g. subscription conditions) may also apply in individual cases, to which separate reference will be made accordingly.

1.3 If a ticket is passed on to a third party, reference must be made to the validity of these GTC. However, the use of tickets as prizes in competitions, raffles, tombolas etc. is not permitted without the prior express written consent of the respective Stage Company.

2. Prices

2.1 The prices (including fixed, optional and other subscriptions and cycles) of the respective stage company shall apply in accordance with the respective valid price lists. The prices include the statutory value added tax.

2.2 The respective stage company reserves the right (in particular for benefit events, groups and the like) to set different prices in individual cases.

2.3 Reduced-price tickets may be purchased by persons belonging to a group of beneficiaries, provided that they can prove their identity by means of a photo ID and any additional proof required for the reduction. The beneficiaries can be found on the website of the respective theater company (www.burgtheater.at, www.wiener-staatsoper.at, www.volksoper.at). If a ticket is misused, the difference to the normal price may be charged and the visitor may be expelled from the event without (partial) reimbursement of the ticket price and further legal action may be taken There is no legal entitlement to discount tickets, specific tickets or ticket categories.

3. Card purchase

3.1 The modalities of ticket purchase can be found in the information on the performance schedules or on the websites of the respective stage company (www.burgtheater.at, www.wiener-staatsoper.at, www.volksoper.at). The number of tickets issued per person may be limited by the Stage Companies.

3.2 When purchasing in the web store (www.burgtheater.at, www.wiener-staatsoper.at, www.volksoper.at), the binding offer to purchase a ticket, product or service is made by clicking on the “Buy”/“Order for a fee” button.

3.3 If “e-ticket” is selected as the desired delivery method when purchasing tickets, a print@home ticket and a wallet file will be sent together with the confirmation e-mail. Either the print@home ticket or the wallet ticket must be presented to the public service upon admission. In certain cases, the respective stage company may provide a “pick-up ticket” instead of the “e-ticket”, with which the ticket can only be picked up at the box office.

3.4 Only the first ticket presented or scanned at admission entitles the holder to enter the event.

4. Postal dispatch

In the case of postal delivery, any additional shipping costs will be shown during the ordering process.

5. Payment methods

Payment shall be made using the payment methods available at the time of purchase/order. Goods or services will only be made available to the customer after payment has been made.

6. Cancellation

6.1 Tickets and time-limited goods (e.g. program booklets for a specific event) can be exchanged for a voucher free of charge within one hour of purchase. This option is not available for purchases made on the day of the event.

6.2 The stage companies are entitled to cancel a purchase if

  • the payment is not authorized by the bank or credit card company or other payment problems occur,
  • the purchaser violates regulations that were pointed out during the booking process or on the website of the respective stage company, or attempts to circumvent them (e.g. violation of the maximum number of tickets per event and purchaser, violation of any prohibition of resale, unauthorized use of discounts),
  • the event is canceled.

7. Cancellation or modification of events

7.1 If an event is canceled without substitution, tickets already purchased will be taken back by the respective Stage Company up to seven days after the day of the event.

7.2 If another work is performed instead of the announced work, tickets already purchased can be returned to the respective Stage Company up to seven days after the day of the event. The respective Stage Company may additionally provide for the option that tickets purchased via the website of the respective Stage Company can be canceled via the website of the respective Stage Company within a certain period of time, but no later than one hour before the start of the event. This only applies to tickets that have not been invalidated (e.g. by removing the tear-off or scanning the ticket).

7.3 Subscription tickets and other tickets for which the work has not been determined in advance, as well as tickets that have not been purchased directly from the stage companies, are excluded from redemption by the stage companies.

7.4 Announcements of the cast are not a basis for the purchase of tickets. The Stage Companies reserve the right to make changes to the cast and artistic changes to the production and shall not be entitled to a return of the tickets or a reduction of the purchase price. This also applies to any defects, failure or other faults in surtitle or subtitle systems and applications or minor postponements of the start of the event.

7.5 It is the Visitor's responsibility to find out about any changes on the day of the event (e.g. through daily newspapers, on the websites or by calling the respective Stage Company).

7.6 If the event is canceled, the ticket price will be refunded if less than half of the performance has been performed at the time of cancellation, or an alternative event will be offered if possible.

7.7 Travel and accommodation costs and other expenses will not be refunded.

8. Right of withdrawal for optional subscriptions, vouchers or merchandise purchased online, by e-mail or by telephone

8.1 If subscriptions for which the events are not fixed (optional subscriptions), vouchers or merchandise items are purchased by telephone, e-mail or via the website, the buyer, if he/she is a consumer, has the right to withdraw from the contract within fourteen days of conclusion of the contract or, in the case of the purchase of goods, within fourteen days of receipt of the goods without giving reasons.

8.2 In order to exercise this right of withdrawal, the Buyer must inform the respective Stage Company of his/her decision to withdraw from the contract by means of a clear declaration (e.g. a letter sent by post, fax or e-mail). The purchaser may use the model withdrawal form below, but this is not mandatory. To comply with the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the expiry of the withdrawal period. If this existing right of revocation is effectively exercised, all payments will be refunded within fourteen days at the latest from the day on which the notification of revocation of the purchase contract is received. If goods have already been delivered to the customer, payments including delivery costs will be refunded within fourteen days of the day on which the goods are returned to the respective stage company. The costs of the return shipment shall be borne by the buyer. Repayment shall be made using the original method of payment; no fee shall be charged for the repayment.

8.3 However, this right of withdrawal does not apply to

  • Tickets for fixed events,
  • sound or video recordings delivered in a sealed package, provided that the seal has been removed after delivery, or
  • delivery of digital content not stored on a physical data carrier, if the respective stage company - with the express consent of the buyer, combined with the buyer's knowledge of the loss of the right of withdrawal in the event of premature commencement

8.4 The purchaser has no right of revocation if he/she redeems optional subscription checks or vouchers within the revocation period and receives tickets for a specific date. Repayment may also be refused until the respective Stage Company has received back vouchers already issued by it or it has been verified that no optional subscription checks or vouchers have been redeemed.

9. Domiciliary rights of the stage companies

9.1 Every visitor is subject to the house rules of the respective Stage Company. The Stage Companies reserve the right to deny the purchase of tickets to persons who disrupt the orderly sale of tickets, the event or other persons, or who endanger safety or violate the respective house rules or instructions of the staff, and to issue a house ban.

9.2 The offering for sale and sale of tickets for events of the Stage Companies by third parties is not permitted in the buildings of the Bundestheater Group.

9.3 The valid ticket must always be shown to the audience service staff on request. It is not permitted to take a seat other than the one indicated on the ticket.

9.4 In the event of violations of the house rules of the respective stage company, the visitor may be expelled from the event or the venue. The purchase price or other further expenses will not be refunded in such cases, nor in the event of late or denied admission due to late arrival.

10. Commercial resale

The resale of tickets for commercial purposes is prohibited without the permission of the respective stage company (the event organizer). In the case of authorized commercial resales, all requirements, in particular with regard to the indication of the original price of the ticket, must be complied with.

11. Prohibition of changing Tickets

Tickets may not be copied or altered; they lose their validity if they are visually altered in an improper manner (e.g. by pasting over/manipulating the price information) or if they are torn off.

12. Image and sound recordings

12.1 Image and sound recordings by visitors are not permitted during the event. During breaks, before and after events and during guided tours, image and sound recordings are only permitted for private purposes. Any further image and sound recordings (including their utilization) require the permission of the respective stage company.

12.2 In the event of unauthorized image and sound recordings, the respective Stage Company is entitled to remove and store mobile telephones, cameras, video cameras, etc. until the end of the event. Recordings made must be deleted immediately. In addition, the visitor may be expelled from the event or the venue by the respective Stage Company and banned from the premises. The respective stage company reserves the right to take legal action and will indemnify and hold itself harmless (in particular in the event of claims made by third parties).

12.3 In the event of image and sound recordings by the Stage Companies or by authorized third parties, the Visitor acknowledges that any recordings made by him/her (and accompanying minors) may be used without remuneration and without restriction in terms of time, space and number in any technical process currently known and developed in the future within the scope of normal exploitation (such as broadcasting the event on TV and the Internet).

13. Violation of general terms and conditions

The respective stage company reserves the right to refuse the purchaser or visitor the purchase of tickets, to expel them from the house or to issue a house ban in the event of a breach of the GTCs. In the event of abuse, the respective stage company reserves the right to take further legal action.

14. Place of jurisdiction, applicable law

The place of jurisdiction for companies and consumers who are not domiciled, permanently resident or employed in Austria at the time the action is brought shall be the competent court in 1010 Vienna. Austrian law shall apply to the exclusion of the conflict of law rules and the UN Convention on Contracts for the International Sale of Goods.
